Real estate ownership titles have two separate and legally recognized components: Usufruct and Nuda property.  

Usufruct provides the legal rights to live and enjoy rents from the property, whereas Nuda property covers all other ownership rights. Each of those two titles can be sold and purchased separately.  

A very common example of usufructs are rentals: When someone rents an apartment, they are temporarily acquiring the right of usufruct, while Nuda propiedad stays with the land-lord. In our case, the Usufruct stays with the elder, and the title of the home moves fully to the buyer.

Nuda propiedad is sometimes translated as "bear property" or "nude property". It is everything but the usufruct.

Our service is based on a simple transaction: The elder sell the Nuda title of their home, keeping exclusive lifelong usufruct. After the elder’s passing, the usufruct extinguishes, and the property can be sold or rented by the buyer, who will then have full control of the rights of the home.

Elder has complete legal protection, as the single rightful owner of the usufruct. The buyer also has full legal protection, and is guaranteed full control after the elder's passing.

Parties can agree on whichever terms they choose. Most commonly, elders pay IBI and community costs, and buyers pay for derramas and insurance.

The transaction costs of Nuda operations lie normally between 500€ and 1000€ and include the notary and the public deed. Buyers may also need to account for ITP (Impuesto Transmisión Patrimonial), which will be paid in two parts: Nuda ITP at contract signature, and Usufruct ITP at decease.

Buying a Nuda Propiedad is very similar to buying a regular house, and follows a very similar legal process. A title transfer is made in front of a registrar, and the contract elevated to public registry, for all participants' safety and protection.

This type of purchase has been in practice for centuries, and is well recognized in legal and fiscal common practice.

A Nuda buyer can expect to have exactly the same level of legal enforcement power available to regular property buyers.

Buyer will agree on specific terms with elder, but standard terms offer between 30 and 60 days for the family to vacate the home after the usufructer's passing.

There are three common Nuda purchase plans:

1. Lump sum payments for their Nuda. A one-time payment. These payments range between 50% to 90% of the current value of the home depending on the age of the owners. Final price is known upfront by both parties.

2. Initial payment plus fixed term annuity. A first payment involving a mutually-agreed fraction of the price is made upon signature; this is complemented afterwards with succeeding monthly payments. Final price is known upfront by both parties.

3. Initial payment plus life annuity. An open-ended contract, with payment maintained throughout the life of the owner.

The contract signed governs this scenario. While each contract is unique, here's an example of common terms in the market: buyers agree to to keep current in their payment obligations in case of annuity payments. If at any point the buyer becomes delinquent by 3 payments, the Nuda contract will be resolved, and Nuda will return fully to the elder. Elder gets to keep all payments received.

This is a "fail-safe" design to protect the elder, and ensure payment continuity. The spirit of this transaction, as reflected in the contracts available, is to safe-guard the interest of the elder throughout the duration of the contract.
